TERMS AND CONDITIONS of "HOW HAS ROSKEN IMPROVED YOUR SKIN?" promotion

  1. Information on How to Enter and prizes form part of these Conditions of Entry.
  2. Entry into this promotion is deemed to be acceptance of these Conditions of Entry.
  3. Entry is open to all Australian residents. Employees of the Promoter related bodies corporate, companies associated with the promotion and their immediate families (spouse, defacto spouse, parent, child or sibling, whether natural or by adoption) of such an employee", associated companies, advertising agencies and participating retailers and their employees are ineligible to enter or win.
  4. Each response to the question must be the entrant’s original work. Entries not fully complying with these conditions of entry may be deemed invalid at the Promoter’s discretion. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  5. This is a game of skill; chance plays no part in this to determine the winners. Each valid entry will be individually judged (by representatives of the Promoter) based on, among other things, literary and creative merit. The judges’ decision is final and no correspondence will be entered into.
  6. Promotion commences 9:00am AEDT on 01.03.2009 and closes in-store at 5:00pm AEDT on 28.02.2010 (“Promotional Period”). Prize judging will be conducted at 12:00pm on the 15th day of every consecutive month. If the 15th falls on a weekend, prize judging will be postponed to the following Monday. All entries must be received no later than the last mail on 09.03.2010. All winners will be notified in writing within 72 hours of the relevant judgement. The person entitled to the relevant prize is the person whose name is used to submit the entry and who can produce the proof of purchase evidencing their Qualifying Purchase.
  7. Provisional winners will be required to produce their original receipt to a Reply Paid address (as nominated by the Promoter in its absolute discretion) in order to validate their entry and claim their prize. The Promoter recommends that winners send their winning claim via registered post; however, this is not a condition of claiming a prize.
  8. Unclaimed Prizes: If any awarded prizes remain unclaimed or claimed but then forfeited for any reason by 5:00pm AEDT 15.04.2010 the Promoter may conduct such further judging at the same place as the original judging took place as are necessary at 9:00am AEDT 15.4.2010, in order to distribute any unclaimed prizes by that date, subject to any written directions under relevant Lottery and Gaming Regulations. Winners will be notified by e-mail, mail and phone.
  9. PRIZES: The first valid one (1) entry best judged every month will each win a Myer Gift Card. Each prize is valued at RRP $200.
  10. Maximum total prize pool is valued at RRP $2,400.
  11. If a prize winner is under the age of 18 years, the prize will be awarded to the winner’s parent or guardian.
  12. A person who does not comply with this condition forfeits their prize. The Promoter may (at its absolute discretion) exclude the prize winner who has not complied with this condition from receiving the prize.
  13. Multiple entries permitted, subject to the following: (a) only one entry permitted per specified purchase; (b) each entry must be submitted separately and in accordance with entry requirements.
  14. Prizes are not transferable or exchangeable and cannot be taken as cash. Promoter accepts no responsibility for any variation in the prize value.

GENERAL

  1. No responsibility accepted for late, lost or misdirected entries. At the Promoters discretion, any contact details incorrectly entered by an entrant may invalidate the relevant entry.
  2. There will be a total of 20,500 entry forms printed.
  3. Incomplete, indecipherable or illegible entries will be deemed invalid.
  4. Entries not completed in accordance with the Conditions of Entry or received after close of entry will not be considered. Incomplete entries will be disregarded.
  5. The Promoters decision in relation to any aspect of the Promotion is final and binding on every person who enters. No correspondence will be entered into.
  6. If for any reason this Promotion is not capable of running as planned, including tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Promotion.
  7. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following:
    (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or gift claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in gift value to that stated in these Terms and Conditions; or (e) any tax liability incurred by a winner or entrant.
  8. CAUTION: Any attempt to deliberately undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law.

PERSONAL INFORMATION

  1. All entries become the sole property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this Promotion. The Promoter may disclose entrants' personal information to its contractors and agents to assist in conducting this Promotion or communicating with entrants.
  2. Entrants consent to the storage of their personal information on the Promoter's database and the Promoter may use this information for future Promotion, marketing and publicity purposes regarding its products.
  3. Entrants can request to access, update or correct their personal information the Promoter holds about them or may request that they not receive further Promotional or marketing communications from the Promoter by contacting the Promoter at the address below or the Promoter’s Privacy Officer on 1800 025 123 to request a copy of the Promoter’s Privacy Policy. Should a participant's contact details change during the Promotion Period, it is the participant's responsibility to notify the Promoter.
  4. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988.
